Summary of the 2008 "Pedigree Bill"
The Florida Society of Plastic Surgeons is committed ensuring that patients are fully informed of the credentials of their health care professionals. It is for this reason that the Society was a leading proponent of the Truth in Medical Education (TIME) Bill, which requires all Florida health care providers to disclose their licensure status prior to initiating any treatment. The TIME Bill also makes a legislative finding that there is a compelling state need to protect the public from misleading advertisements, including claims of "board certification" from sham organizations; this finding provides the legislative foundation to the Board of Medicine's rule that a physician may not claim board certification unless the board has received recognition from the American Board of Medical Specialties or the Florida Board of Medicine.
In the Society's estimation, meaningful board certification should require an ACGME-approved residency in that specialty. Therefore, the Florida Society of Plastic Surgeons continues to oppose any attempts to recognize agencies that claim to bestow "board certification" on those who have not undergone such a residency.
On May 30, 2007, CMS issued its National Provider Identifier ("NPI") Data Dissemination Notice in the Federal Register. The NPI, which is a unique 10-position identification number, is required of all health care providers as of May 27, 2007, including physicians who perform HIPAA-governed electronic billing.
Somewhat ironic is the fact that although the NPI is governed by HIPAA, the goal of which was to ensure the privacy of medical information, the NPI itself has been deemed to be a public record and is therefore scheduled to be made publicly available on June 28. The American Medical Association has publicly objected to this interpretation of the Freedom of Information Act, through which the public will have access to a free query-only database.
As a result of the dissemination of this information, many physicians will want to delete from the National Plan and Provider Enumeration System (NPPES) any "optional" information that they may have given during the NPI application process, such as the physician's DEA number (information such as Social Security Numbers and dates of birth will not be provided). Unfortunately, CMS will allow such deletions only through the end of June, 2008, at which time the entire file will be made public.

The Florida Board of Medicine's Legislative, Rules, Surgical Care, and Quality Assurance Committees met recently with universally positive developments. The Florida Society of Plastic Surgeons has worked long and hard on all of these issues.

There are almost twice as many non-FSPS-member plastic surgeons in the state as there are members; this fact means that your dues money buys advocacy for not just you, but also for non-members who are not paying dues at all. This list of surgeons by county includes all the non-FSPS plastic surgeons in the state about whom we are aware. If you know of others, please let the FSPS office know so that we can add non-members to the list for recruitment projects. Please review the list and choose a few names to target for recruitment.
