2026 Mid-Session Update

May 2025 Advocacy Report

With the 2026 Legislative Session now past its midpoint, the FSPS legislative priorities are still in play, with one possible (good) exception.

Unlike in years past, there is no viable, existential threat to office surgery.  In fact, the only Office Surgery bill in play is HB 1175, which has been amended to our liking to limit new office surgery suites to six incapacitated patients, after which ASC Building Code standards would have to be met.

We were also able to file legislation this year to finally regulate medspas.  While both bills (HB 1429 and SB 1728) are currently in legislative purgatory, we are heartened to see the Legislature at least address this urgent issue.  Likewise, legislation to regulate Post-Surgery Recovery Centers (HB 81 and SB 404) has yet to be heard.

As always, Scope of Practice remain a legislative priority.  Already the House has passed legislation that would grant autonomous practice to CRNA’s and Mental Health APRNs, and a bill to allow full autonomous practice to all APRNs has only one more committee to pass before arriving on the House Floor.  Our efforts are now focused on the Senate, where none of these initiatives is currently on the Legislative Agenda.
